Please read these Terms of Service ("Terms") carefully before using the Promps and Promps Pro applications (the "Software") operated by Promps ("us", "we", or "our").

1. Acceptance of Terms

By downloading, installing, or using the Software, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the Software.

2. License Grant

Free Version (Promps)

The free version of Promps is provided under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the conditions of the MIT License.

Pro Version (Promps Pro)

Upon purchase of a valid license, we grant you a non-exclusive, non-transferable license to:

• Install and use Promps Pro on devices you own or control
• Use the Pro features for personal or commercial purposes

You may NOT:

• Share, distribute, or resell your license key
• Reverse engineer, decompile, or disassemble the Pro features
• Remove or alter any proprietary notices

3. Purchases and Payments

Purchases of Promps Pro are processed by Paddle.com Market Limited ("Paddle"), our authorized reseller. By making a purchase:

• You agree to Paddle's Terms of Service
• Paddle is the Merchant of Record for all purchases
• You will receive a license key upon successful payment

4. Refund Policy

We offer a 30-day money-back guarantee for Promps Pro. If you are not satisfied with your purchase, you may request a refund within 30 days of purchase by contacting [email protected].

5. Software Updates

We may release updates to the Software from time to time. Updates may include bug fixes, new features, or security patches. We recommend keeping your Software up to date.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

7. Limitation of Liability

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

8. Third-Party Services

The Software may integrate with third-party AI services (such as OpenAI, Anthropic). Your use of these services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or content of these third-party services.

9. Intellectual Property

The Promps name, logo, and Pro features are the intellectual property of Promps. The open-source components of Promps are subject to the MIT License.

10. Termination

We may terminate or suspend your license immediately, without prior notice, for any breach of these Terms. Upon termination, you must cease all use of the Pro features.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Software after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
